Council backs independent legal advice for Cromwell endowment land

Central Otago District Council has approved funding for independent senior legal advice as the Cromwell Community Board works through the future of land that has been tied to the town for more than a century.

The decision follows a request from the community board for its own legal counsel to examine the status of Cromwell’s historic endowment land and the obligations attached to it. Council says the central question is whether the land, and income generated from it, must continue to benefit Cromwell specifically or whether it is now held for the wider Central Otago district.

The land has deep historical roots. Council records show it was transferred from the Crown in 1881 to the Mayor, councillors and burgesses of the Borough of Cromwell as an endowment for the municipality. Historical material published by the council says the borough once held close to 1,000 acres of endowment land between Cromwell and Bannockburn. Responsibility later passed to Central Otago District Council following the 1989 local government reorganisation.

The Cromwell Community Board asked for further information and independent legal advice at its 1 September meeting. It also sought the ability to select and instruct its own senior counsel, allowing the legal issues to be considered specifically from Cromwell’s perspective.

Cromwell Community Board chair Anna Harrison described council approval as an important first step, while stressing the board still has substantial work ahead as it seeks clarity about the endowment’s future.

Up to $50,000 for the independent advice will be funded from future sales of Bannockburn endowment land. The community board will define the questions and instructions for counsel once a lawyer has been selected.

The issue sits alongside a broader programme for managing Cromwell endowment assets. Council adopted a Cromwell Endowment Land Investment Strategy in July 2025, intended to guide decisions involving housing, commercial and industrial development, infrastructure and other possible uses. Council information on the Bannockburn Road industrial development says that project covers about 49 hectares of endowment land, with an initial stage of roughly 10 hectares.

An updated report is due to go before the Cromwell Community Board on 6 October. Any subsequent actions and decisions are expected to return to the relevant community boards and council after the independent advice has been received.
